1. Introduction

Welcome to AVOS® ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website www.avostherapy.com. Our products, services, and any other platforms where we operate (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

2. Company Identity & Intellectual Property

Healthy Active Life Ethos LLC, a California limited liability company ("Hale LLC"), doing business as AVOS operates AVOS. "AVOS" is used in connection with our website (www.avostherapy.com) and related services. While we are not pursuing formal trademark registration for 'AVOS Therapy,' our continued use of 'AVOS Therapy' in commerce establishes common law protections. Unauthorized use of our branding, trade dress, or any confusingly similar marks is strictly prohibited. 

Our patents, including U.S. Patent No. 11,116,687, and any pending patents, protect our proprietary technology. Unauthorized reproduction, reverse engineering, or sale of derivative products is strictly prohibited. We reserve the right to enforce our intellectual property rights to the fullest extent of the law.

All content on our website and related materials, including product instructions, text, images, software, and video, are protected under intellectual property laws. You may not copy, distribute, or reproduce any content without prior written permission.

3. Eligibility

By using our Services, you confirm that you are at least 18 years old or have permission from a legal guardian. If using our Services on behalf of a business or entity, you confirm that you have the authority to bind them to these Terms.

4. Orders, Payments & Refund Policy

  • Order Acceptance: We reserve the right to refuse or cancel any order at our sole discretion.

  • Pricing & Errors: While we strive for accuracy, we are not responsible for pricing errors. If an error occurs, we may cancel your order and issue a refund.

  • Refunds & Returns:

    • We replace manufacturer defects for a 1 year. 

    • We offer a one-time size replacement per order at no additional cost.

    • Customers should contact info@avostherapy.com for assistance.

    • Return Processing Time: Once we receive a return shipment, please allow 2–4 weeks for processing. This includes inspection, verification, and final resolution or replacement. We appreciate your patience during this time.

5. Preorders & Out-of-Stock Items

  • Preordered items or backorders may be delayed due to supply chain issues. Estimated shipping times are not guaranteed.

  • You can request a refund by contacting info@avostherapy.com.

6. Shipping & Delivery

  • These Terms apply to all international users, but where local consumer protection laws override specific terms, we comply only to the minimum extent required by law.

  • Customers are responsible for ensuring AVOS products comply with their local laws before purchase. AVOS is not responsible for customs seizures, import bans, or legal restrictions in foreign jurisdictions.

  • Estimated delivery times are for guidance and not guaranteed.

  • We are not responsible for lost, stolen, or delayed shipments once they leave our facility. Customers who have purchased 'Shipping Protection by Route' through Shopify must contact Route directly per their terms, as we are not affiliated with Route and do not manage their claims process.

  • International customers are responsible for customs duties and import taxes.

7. User-Generated Content & Testimonials

By submitting reviews, testimonials, photos, videos, or any statements ("User Content"), you grant us a worldwide, royalty-free, perpetual license to use and distribute such content, including for marketing, promotional, and advertising purposes. This includes testimonials from customers and statements from medical professionals, provided they have given express permission. You agree:

  • We may use your content for marketing purposes, including but not limited to advertisements, website content, and social media promotions.

  • You have the legal rights to share the content.

  • Your content does not violate any laws or make unverified health claims that could misrepresent product efficacy.

We may remove or edit User Content at our sole discretion, particularly if it is found to be false, misleading, or in violation of regulatory guidelines, including but not limited to those set by the FTC, FDA, or advertising platforms. We are happy to remove personal details by request - info@avostherapy.com.

8. Third-Party Links, AI Services & Liability

Our website may contain links to third-party websites, including AI-driven services such as Anagram at www.anagram.ai. We do not control or endorse these third-party services and are not responsible for their content, policies, recommendations, or services. Any AI-generated responses provided through Anagram are for informational purposes only and do not constitute professional or legally binding advice. Users are responsible for verifying any AI-generated recommendations before acting on them. By using Anagram or any third-party service, you agree to be bound by their respective terms of use, which can be found at www.anagram.ai/terms. AVOS disclaims all liability for AI-generated content, and any disputes arising from the use of such services must be addressed with the third-party provider directly.

9. Product Use Instructions & Packaging Protections

  • Product packaging and inserts include safety disclaimers and limitations of liability. Customers are responsible for reviewing these before use. Failure to follow them may void any warranties or claims.

  • Our products are not intended to diagnose, treat, cure, or prevent any disease, and no medical claims are made regarding their effectiveness. Statements about our products have not been evaluated by the FDA.

  • These Terms of Service apply in conjunction with any disclaimers or terms printed on our product packaging, and where discrepancies exist, the most protective provisions in favor of AVOS shall apply.

  • Advertising and marketing content related to our products complies with applicable regulations, including Google Ads and Meta advertising policies, ensuring that no misleading health or medical claims are made. While we strive for accuracy in all marketing materials, we do not guarantee that all statements will always be error-free. In the event of an inadvertent misstatement or regulatory concern, these Terms of Service govern our liability and shall take precedence over any conflicting marketing claims.

10. Disclaimers & Limitations of Liability

  • International Use Disclaimer: These Terms are designed to comply with U.S. laws. If you access or use our Services from outside the U.S., you do so at your own risk, and it is your responsibility to ensure compliance with local laws. AVOS is not responsible for foreign legal claims or regulatory compliance outside of the U.S.

  • FDA Disclaimer: Our products and content are not intended to diagnose, treat, cure, or prevent any disease. Statements have not been evaluated by the FDA.

  • Use at Your Own Risk: Our products should be used as instructed. We provide suggested use guidelines, but individual results and experiences may vary. We do not control or monitor how our products are used, and improper use, modification, or deviation from suggested guidelines may result in injury or unintended effects. AVOS and Hale LLC are not responsible for harm, damages, or claims arising from misuse, failure to follow instructions, or any consequences beyond our direct control.

  • No Guaranteed Results: Individual results vary. We do not guarantee specific outcomes from product use.

  • Liability Cap: Our total liability to you shall not exceed the amount you paid for the product or service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless AVOS, Hale LLC, and its employees from any claims, liabilities, damages, or legal fees arising from:

  • Your use of our Services.

  • Your violation of these Terms.

  • Your submission of User Content.

  • Any legal claims related to misuse of our products.

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of California, without regard to conflict of law principles.

  • Any disputes shall be resolved through binding arbitration in Los Angeles County, CA, rather than in court.

  • Class-Action Waiver: You waive any right to participate in class-action lawsuits against AVOS.

13. Warranty Policy

  • Manufacturer defects are covered for one (1) year from the date of purchase.

  • We strive to accommodate any concerns beyond the warranty period whenever possible.

14. Data Privacy & Compliance

  • By using our Services, you consent to your data being processed in the United States under our Privacy Policy, which may not offer the same protections as your local data laws, including GDPR and PIPEDA.

15. Promotions, Sweepstakes, and Giveaways

  • From time to time we may offer promotions, sweepstakes, or giveaways (“Promotions”). Each Promotion is governed by its own Official Rules, presented at the point of entry and incorporated here by reference. If these Terms conflict with the Official Rules, the Official Rules control for that Promotion. By entering any Promotion, you agree to be bound by the applicable Official Rules, our Privacy Policy, and Sponsor’s decisions.
  • Prize Use & Assumption of Risk. Some prizes may involve physical activity (e.g., skateboarding). Prize use is at your own risk as described in the Official Rules; to the maximum extent permitted by law, you release Sponsor from claims arising from prize use, excluding claims caused by Sponsor’s gross negligence or willful misconduct.
